    You are allowed to work part-time or full-time as a freelancer on h1b. The H-1B is not wrongfully labeled "temporary" because it's temporary in the sense that the applicant only gets 3 years at most since they need to renew it every few years. Since you can't stay forever, being able to work for yourself is something that will have benefits both financially and mentally. Being able to work for yourself gives entrepreneurs room for creativity, unlike the typical 9-5 job where your creativity is limited by what your company says you can do with your time.

    Yes. If you have an H-1B visa, it's legal to work remotely for a U.S company so long as you remain outside the US more than half the time while on the H-1B visa. Whether or not this is a good idea may be dependent on your skillset and how much demand there is in your industry for remote workers, that said it's definitely something I don't see happening very often because most companies that want remote workers are looking for people with higher resource (and English) levels than what most H-1B foreign workers generally provide.

    Yes. You are allowed to work as an independent contractor for other companies while your h1b visa holder is valid, so you will need to submit tax returns every year. If the company you are working for does not give you a 1099 contact us immediately. Also, if the company claims that they do provide 1099's but continues following through on their promise then please contact us at your earliest convenience. As this would be bogus and fraudulent behavior on behalf of the company claiming to be providing 1099'S legally which should not happen under any circumstance(s).

    I believe so. Apply for a specialty occupation visa and open a business account with a bank of your choice before post the application on the USCIS. There is an exception to the "J-category" which allows certain types of international professionals to work in the US while on a H1B visa or other temporary working visas. This J-category is called excludable, meaning they are exempt from labor protections afforded by nonimmigrant worker statutes (i.e., these professionals do not receive U.S. Work Permits).

    You would need to make self sufficient income or business revenue for this scenario. The qualification of "qualifying" usually depends on different factors such as field, type of visa and employer. Bachelor's degree is required for primary professions like healthcare, education etc. Higher degrees are usually preferred for managerial professionals like VP or director level positions in private companies or research institutes. Granted that you meet the criteria mentioned above, currently you can work without H1B if your employer sponsors/sponsors your H1B visa (allowing you to do the job).

    You are allowed to work as a freelancer on h1b, however no other person may engage in the specific services you are rendering either inside or outside of your home - this includes family members. If you decide to take freelance clients, make sure to structure your day so that it's not difficult for you to turn down requests from non-clients. During "off" hours, email the client that you're unavailable for their project today and avoid any personal projects during times where there might be chances of overlap with work time.
